This Privacy Policy ("Policy") describes how TDS Desk ("Company," "we," "us," or "our") collects, uses, stores, processes, shares, and protects information when you access or use our website at www.tdsdesk.in ("Website"), our software application ("Software"), and all related services (collectively, the "Services"). This Policy applies to all visitors, users, and others who access the Services.

By using our Services, you consent to the collection and use of information in accordance with this Policy. If you do not agree with any part of this Policy, please do not use our Services.

1. Information We Collect

We collect information to provide and improve our Services. The types of information we collect include:

1.1 Information You Provide Directly:

  • Account Information: Name, email address, phone number, business name, professional role/designation, PAN number, TAN number, and other details provided during registration or waitlist signup
  • TDS Filing Data: Deductee details (names, PANs, addresses, payment amounts, TDS details), challan information, employer/deductor details, salary breakdowns, and other data entered into the Software for preparing TDS returns
  • Contact Information: Information provided when you contact us through forms, email, chat (ASK Diya), or support tickets, including name, email, phone, and message content
  • Payment Information: If applicable, billing address, payment method details (processed securely through third-party payment processors — we do not store full credit/debit card numbers)
  • Feedback and Communications: Survey responses, reviews, feedback, and any communications you send to us

1.2 Information Collected Automatically:

  • Device Information: Browser type, operating system, device type, screen resolution, language preferences
  • Usage Data: Pages visited, time spent on pages, click patterns, navigation paths, features used, frequency of use, search queries within the Software
  • Log Data: IP address, access timestamps, referring URLs, error logs, server response times
  • Cookies and Tracking Technologies: We use cookies, web beacons, pixel tags, local storage, and similar technologies to collect information about your browsing behavior. See Section 7 for details.
  • Location Data: Approximate geographic location derived from your IP address

1.3 Information from Third Parties:

  • Information from TRACES, NSDL, or other government portals accessed through our integrations (with your authorization)
  • Information from analytics providers (Google Analytics or similar)
  • Information from advertising and marketing partners

2. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide, maintain, operate, and improve the Services
  • To process TDS return calculations, FVU file generation, PAN verification, and other Software functions
  • To create and manage your account
  • To communicate with you, including service announcements, updates, security alerts, and support messages
  • To send promotional communications (with your consent, where required by law)
  • To process waitlist registrations and notify you of product launches
  • To personalize your experience and deliver relevant content
  • To monitor and analyze usage patterns, trends, and effectiveness of the Services
  • To detect, prevent, and address fraud, security breaches, and technical issues
  • To comply with legal obligations, enforce our Terms of Use, and protect our rights
  • To facilitate business transfers (mergers, acquisitions, asset sales)

3. Legal Basis for Processing (where applicable)

  • Service Providers: Third-party vendors who assist us in operating the Services (hosting, analytics, email delivery, payment processing, customer support). These providers are contractually obligated to protect your data.
  • Government Portals: When you use our TRACES or NSDL integration features, data is transmitted to the respective government portals as required for TDS filing.
  • Legal Requirements: When required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of TDS Desk, our users, or the public.
  • Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets.
  • With Your Consent: For any other purpose with your explicit consent.

5. Data Storage and Security

Your data is stored on secure servers located in India. We implement industry-standard technical and organizational security measures including:

  • AES-256 encryption for data at rest
  • TLS 1.2+ encryption for data in transit
  • Access controls and authentication mechanisms
  • Regular security audits and vulnerability assessments
  • Secure backup procedures

However, no method of transmission or storage is 100% secure. We cannot guarantee absolute security. You use the Services at your own risk. TDS Desk shall not be liable for any unauthorized access, data breach, or data loss despite our reasonable security efforts.

6. Data Retention

We retain your personal data for as long as: (a) your account is active; (b) reasonably necessary to provide the Services; (c) required by applicable law (including tax record retention requirements); or (d) needed to establish, exercise, or defend legal claims. When no longer needed, data will be securely deleted or anonymized.

7. Cookies and Tracking Technologies

We use cookies and similar technologies for:

  • Essential Cookies: Required for the Website and Software to function
  • Analytics Cookies: To understand how users interact with our Services (e.g., Google Analytics)

Your data is primarily stored and processed in India. If data is transferred outside India, we will ensure appropriate safeguards are in place in accordance with applicable data protection laws.

11. Third-Party Links

The Services may contain links to third-party websites (including filingprochennai.com, TRACES, NSDL, and others). We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use after changes constitutes acceptance. For material changes, we will make reasonable efforts to notify you via email or Website notice.
